Domain Name Matters in China

Mokpoon provides assistance in the process of domain name/keywords/wireless keywords registrations in China, and represents clients with administrative proceedings for disputed domain name/keywords/wireless before the CIETAC Domain Name Dispute Resolution Center, and litigation matters before the court.

◆Procedures of Administrative Proceeding Process
With regard to a dispute involving a .CN domain name, Chinese domain name, keywords or wireless keywords, the general steps are as follows:

a) The Complainant files a Complaint with the secretariat of the CIETAC Domain Name Dispute Resolution Center;
b) The secretariat of the CIETAC Domain Name Dispute Resolution Center notifies the registered holder of the disputed domain name/keywords and sends a copy of the Complaint to the registered holder;
c) the registered holder of the disputed domain name/keywords files a Response;
d) the secretariat of the CIETAC Domain Name Dispute Resolution Center selects the Panel of one or three persons, as the case may be, which will conduct the administrative proceeding in respect of the disputed the disputed domain name/keywords and which will make a determination in regard to the dispute;
e) the Panel conducting the administrative proceeding renders its Decision;
f) if the Decision of the Panel conducting the administrative proceeding requires that the disputed domain name/keywords be cancelled or transferred, the Decision is to be implemented.

◆Time Frame of Administrative Proceeding Process

It generally take less than 60 days from the date a Complaint is duly filed with the CIETAC Domain Name Dispute Resolution Center until the Parties and the relevant Registrar are notified of the Decision of the Panel conducting the administrative proceedings.
Note: Alternatively, the complainant may institute an action concerning the same dispute with the Chinese court at the place where CNNIC’s principal office is located.
